Does the United States Still Exist?

Historically, a government that can, without due process, throw a citizen into a dungeon or summarily execute him is considered to be a tyranny, not a democracy. By any historical definition, the United States today is a tyranny. Continue reading

Advocates of Centralized Power Betray the Constitution

The Constitution doesn’t authorize the federal government to regulate marriage. But some people seem to be fine with the Supreme Court exercising any power, as long as it suits their agenda. Continue reading

The War of 1861

The 1783 Treaty of Paris ended the war between the colonies and Great Britain. Its first article declared the 13 colonies “to be free, sovereign and independent states.” These 13 sovereign nations came together in 1787 as principals and created the federal government as their agent. Principals have always held the right to fire agents. In other words, states held a right to withdraw from the pact — secede. Continue reading

Socialists Dance on Jefferson’s Grave

This has been the pattern of many in power throughout the ages. It matters little which class or cause they claim to represent. What they invariably ignore is that awesome power carries with it awesome responsibility. Continue reading

New California Law Rejects NDAA Indefinite Detention

This language of AB351 goes far beyond what has been considered in most other states, which focus solely on indefinite detention powers under the 2012 National Defense Authorization Act (NDAA), and nothing else. Donnelly’s legislation broadened the scope by recognizing that indefinite detention should not be complied with no matter what federal law is used to justify it. Donnelly confirmed this broad scope, “AB351 will prevent California from implementing indefinite detention for any reason.” Continue reading

Words of Wisdom: Thomas Paine

“A constitution defines and limits the powers of the government it creates. It therefore follows, as a natural and also a logical result, that the governmental exercise of any power not authorized by the constitution is an assumed power, and therefore illegal.”
— Thomas Paine Continue reading

California Bill to Nullify NDAA Unanimously Passes Committee

The legislation is designed to free California from having to comply with the National Defense Authorization Act (NDAA) of 2012, which does nothing to prevent the potential seizure and indefinite detention of U.S. citizens. The California bill declares such federal power unconstitutional, and mandates the state and its localities refuse adhering to or assisting with federal implementation. Continue reading

There’s Nothing Radical about Nullification

Apparently he can’t think of a single reason that nullification should be used by states or local governing bodies. The logical implication is that opponents of slavery – that is advocates of freedom – in the antebellum period were wrong to have used nullification as a means to protect the lives and freedom of former slaves. No doubt, Harriet Tubman would be described by Benen as a radical, and her willful defiance of federal slave laws would be denounced, had the two been contemporaries. Continue reading

Obama Ignores Nullification, Says Federal Agents Will Enforce Obamacare

In a move that is reminiscent of the tyrannical actions of Abraham Lincoln that led to the War of Northern Aggression, Barack Obama says that he will not wait on states to enforce Obamacare. Instead his administration has announced its intent is to completely disregard the state’s Tenth Amendment rights to nullification of the Obamacare law, via their passed legislation and state constitutions. Continue reading

Nullification for Lawyers

Jefferson and Madison did not base their principles of nullification on the fact that the Constitution had not established an ultimate authority. They based their principles on the fact that the people of the states ARE the ultimate authority – not the federal government they created. Jefferson makes this clear in the first few lines of the Kentucky Resolution of 1798. Continue reading

Presidents’ Day

The Constitution is not flawed; the only flaws are in the corrupt and ambitious people in whom we placed our trust — and in ourselves for allowing them to bastardize the original words and meaning of the Constitution’s laws to carry favor with those who will keep them in power. This must end. Continue reading

Secession, Sovereignty, and Salvation: Jefferson Lives!

We are a Rule of Law nation, born of the Enlightenment. We formed our federal government to work at the pleasure of Rule of Law States. We must remind ourselves (and the neo-federalists) that these laws were devised to protect a Sovereign People — by prohibiting the rule of unscrupulous men.

We must learn how to leverage our supreme laws and unalienable rights, effectively and enduringly. Learn to embrace State electoral politics. Learn to engage our State legislators, governors, and attorneys general. Learn how to petition through the courts, properly, and with critical mass. Continue reading

Texas NDAA Nullification Bill Includes Criminal Charges for Federal Agents

At the close of 2011, Barack Obama signed the National Defense Authorization Act for the year 2012. In it are what some constitutional experts consider to be some of the greatest constitutional violations in American history. At issue are sections 1021 and 1022 which, in essence, create a new power for the federal government to “indefinitely detain” – without due process – any person. Indefinitely. That’s little different than kidnapping. Continue reading

Words of Wisdom: Joseph Story

“The state governments have a full superintendence and control over the immense mass of local interests of their respective states, which connect themselves with the feelings, the affections, the municipal institutions, and the internal arrangements of the whole population. They possess, too, the immediate administration of justice in all cases, civil and criminal, which concern the property, personal rights, and peaceful pursuits of their own citizens.” Continue reading
