On Constitution Day: ‘A Republic, if You Can Keep It’

It is remarkable the number of citizens that regard the United States of America as a ‘democracy.’ It is, of course, a Constitutional Republic, and always has been so. Thomas Jefferson regarded the distinction as such: “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.” This article, slightly revised from its original form, first appeared in the November 6, 2000 issue of The New American. It is appropriate that we reacquaint ourselves with our Republican form of government on this Constitution Day 2014. Continue reading

New California Law Rejects NDAA Indefinite Detention

This language of AB351 goes far beyond what has been considered in most other states, which focus solely on indefinite detention powers under the 2012 National Defense Authorization Act (NDAA), and nothing else. Donnelly’s legislation broadened the scope by recognizing that indefinite detention should not be complied with no matter what federal law is used to justify it. Donnelly confirmed this broad scope, “AB351 will prevent California from implementing indefinite detention for any reason.” Continue reading

The Left’s Moral Relativism

President Obama’s recent Mideast trip included a press conference in Ramallah where he stood under a conspicuously large banner of Yassar Arafat, former chairman of the Palestine Liberation Organization, responsible for the deadly bombings of hundreds of innocent Israeli civilians.

Conservative pundits promptly questioned the willingness of our incessantly “optics” conscious president to be photographed against a backdrop of Arafat’s image. They contrasted this with his administration’s previous request to cover up all religious symbols visible in the backdrop at a speech given at the Roman Catholic-based Georgetown University in 2009. Thomas Jefferson: Liberty and Power

It seems to me that in our present condition, the only means of getting judges, legislators, and executives to consult the actual provisions of the Constitution and to obey the oaths they take to observe its bounds and protect it is to adopt sanctions against its violation or evasion. In sum, it should be made a crime punishable by removal from office for any government officer, including members of Congress, to participate affirmatively in any act not authorized by or in violation of the Constitution. Trial for those accused should be in United States District Courts before a jury charged with determining whether a violation has taken place and a judge empowered to remove them from office. Obama vs. the Rule of Law

We are a constitutional republic. Broad fundamental laws and a separation of powers protect the American people from the arbitrary rule of men. Our founding fathers designed a system that was meant to keep a liberal democracy from degenerating into mob rule. They knew that mere legality, the creation of statutes, can violate the rights of the individual as much as a lawless tyrant or monarch. Decades later, Alexis de Tocqueville, commenting on “Democracy in America” popularized the phrase “the tyranny of the majority” to describe a degenerate democracy that violates the rights of a minority.
