On Constitution Day: ‘A Republic, if You Can Keep It’

It is remarkable the number of citizens that regard the United States of America as a ‘democracy.’ It is, of course, a Constitutional Republic, and always has been so. Thomas Jefferson regarded the distinction as such: “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.” This article, slightly revised from its original form, first appeared in the November 6, 2000 issue of The New American. It is appropriate that we reacquaint ourselves with our Republican form of government on this Constitution Day 2014. Continue reading

James Madison: How the States Can Block Federal Gun Control

What do we do when the federal government simply ignores the Second Amendment and acts in ways that infringe on our right to keep and bear arms? Well, James Madison laid out a blueprint in Federalist 46 before the Constitution was even ratified. Continue reading

Constitution Day: Reminding Our Elected Representatives to Exercise Their Power

Nullification for Lawyers

Jefferson and Madison did not base their principles of nullification on the fact that the Constitution had not established an ultimate authority. They based their principles on the fact that the people of the states ARE the ultimate authority – not the federal government they created. Jefferson makes this clear in the first few lines of the Kentucky Resolution of 1798. Continue reading

The Kentucky and Virginia Resolutions: Guideposts of Limited Government

For true change to take place, Americans must once again conceive of their history as a struggle to create and maintain real freedom. Part of that reconceptualization would entail making a place for the Kentucky and Virginia resolutions in the pantheon of American charters. The resolutions articulate the fundamental principles of our government in an eloquent yet logical manner; in their import, they rank second only to the Constitution. For Americans who would recreate a limited federal government of enumerated powers — the government created by the Founders — the resolutions can serve as an enduring inspiration. Continue reading

Ignorance + Depravity → Slavery + Ruin

“But still the people themselves must be the chief support of liberty. While the great body of the freeholders are acquainted with the duties which they owe to their God, to themselves, and to men, they will remain free. But if ignorance and depravity should prevail, they will inevitably lead to slavery and ruin.” — Oliver Ellsworth (at the Connecticut ratifying convention, 1788) Continue reading

Bypassing the People, the Congress, and the Constitution

Were these comments really intended as trial balloons to gauge public reaction to new forms of tyranny? Declaring “emergencies” (on both sides of the political aisle) seems to be the surest way to get things done lately, whether it involves going to war, forcing Americans to buy products, or spending trillions of dollars that we do not possess. Continue reading
