On Constitution Day: ‘A Republic, if You Can Keep It’

It is remarkable the number of citizens that regard the United States of America as a ‘democracy.’ It is, of course, a Constitutional Republic, and always has been so. Thomas Jefferson regarded the distinction as such: “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.” This article, slightly revised from its original form, first appeared in the November 6, 2000 issue of The New American. House and Senate Quietly Pass Bigger & Badder 2014 NDAA

Yesterday the 2014 National Defense Authorization Act was fast-tracked through the Senate. The indefinite detention allowed by the original NDAA is still here, and it’s actually worse now, because there are provisions that will make it easier for the government to target those who disagree. Section 1071 outlines the creation of the “Conflict Records Research Center,” where the unconstitutionally obtained information that the NSA has collected is compiled and shared with the Department of Defense. The information, called in the wording “captured records,” can be anything from your phone records, emails, browsing history or posts on social media sites. Continue reading

New California Law Rejects NDAA Indefinite Detention

This language of AB351 goes far beyond what has been considered in most other states, which focus solely on indefinite detention powers under the 2012 National Defense Authorization Act (NDAA), and nothing else. Donnelly’s legislation broadened the scope by recognizing that indefinite detention should not be complied with no matter what federal law is used to justify it. Donnelly confirmed this broad scope, “AB351 will prevent California from implementing indefinite detention for any reason.” Continue reading

Why We Should Mistrust the Government

It should come as no surprise that President Obama told Ohio State University students at a graduation ceremony last week that they should not question authority and they should reject the calls of those who do. He argued that “our brave, creative, unique experiment in self-rule” has been so successful that trusting the government is the same as trusting ourselves; hence, challenging the government is the same as challenging ourselves. He blasted those who incessantly warn of government tyranny.

Yet, mistrust of government is as old as America itself. America was born out of mistrust of government. The revolution that was fought in the 1770s and 1780s was won in the minds of Colonists in the mid-1760s when the British imposed the Stamp Act and used writs of assistance to enforce it. The Stamp Act required all people in the Colonies to have government-sold stamps on all documents in their possession, and writs of assistance permitted search warrants written by British troops in which they authorized themselves to enter private homes ostensibly to look for the stamps.
